New Jersey’s new no fault divorce law made headlines this past week when New Jersey Nets basketball player, Jason Kidd, amended his divorce petition from “extreme cruelty” to “irreconcilable differences.”

New Jersey couples who cite irreconcilable differences will now be able to get a divorce in six months. The waiting period in New Jersey was previously 18 months for a no fault divorce. California was the first State to institute no fault divorce in 1970 and now most states have no fault divorce although a handful of states still require an allegation of fault. The waiting periods also vary from state to state.

While New Jersey has made no fault divorce more readily available, there has been recent movement in some states to bring back fault.
